The House of Insomnia Crypto Store (“Store”) is an online service operated by Kreation Verse Inc., (including its affiliates, “Kreation”). This Store is only an interface allowing users to purchase digital items (i.e., Non-Fungible Token or NFT) by using Ethereum and other crypto currencies. You are entirely responsible for the safety and management of your own private wallets and validating all transactions and contracts generated by this Store. This Store is based on the smart contract on the Ethereum network, and there is no ability to undo, reverse, or restore any transactions.

Kreation provides this Store and the related or connected services thereto on an “as is” and “as available” basis without any warranty of any kind, including implied warranties. By using this Store in any manner, you are deemed to accept sole responsibility for any transactions involving this Store.

1. Kreation does not guarantee your purchase of an NFT, even if you place an offer.
2. If you successfully purchase an NFT, you own the NFT. However, Kreation retains the copyrights, trademarks, trade dresses and any other intellectual properties to the content of the NFT even after your purchase of the NFT. You are entitled to use the content of the NFT in your ownership for your own personal and non-commercial use, only during your ownership of the NFT.
3. If you purchase NFT, you may be entitled to obtain a physical item that Kreation designates (“Physical Item(s)”). In order to receive the Physical Item, to which you are entitled (if any), you are required to provide Kreation with your personal information necessary to ship and deliver such Physical Item to you. Kreation shall have the right to hold shipment and delivery of such Physical Item until and unless you provide Kreation with your correct information that Kreation requires.
4. Kreation will handle your personal information that you provide to us in accordance with our Privacy Policy. For the details of our Privacy Policy, please see http://www.kreation.jp.
5. Shipment of the Physical Item(s) will be handled by GR8888 Co., Ltd (www.gr8.jp)(“GR8”). By providing Kreation with your personal information, you agree that Kreation will provide your personal information to GR8 for shipment of the Physical Item(s) to you.
6. While each of Kreation and GR8 use its endeavor to ship and deliver the Physical Item to which you are entitled (if any) in a timely manner, Kreation or GR8 makes no representations or warranties with respect to shipment or delivery of the Physical Item.
7. Any Physical Item, if any, is a gift for a user who purchased a certain NFT, and you are not able to purchase any Physical Items. Any Physical Item, if provided by Kreation, is provided on an “as is” and “as available” basis without any warranty of any kind, including any implied warranties. You have no rights to request Kreation to return, exchange or repair any Physical Item or no rights to make any claims or allegation to or against Kreation and its designees (including GR8) in relation to any Physical Item.
8. For the avoidance of doubt, you are not entitled to cancel or return the NFT that you purchased in any case, in particular, even if there is any difference in size, color, material, specification or any other elements from photographs, motion pictures, illustrations, drawings, images, descriptions or your expectations of the Physical Item in or in relation to a Physical Item.
